Welcome to HostConcierge.ai (“HostConcierge,” “we,” “us,” or “our”). By accessing or using the HostConcierge.ai platform and related services (the “Service”), you agree to these Terms of Service (“Terms”). If you do not agree to these Terms, you may not use the Service.
1. Description of the Service
HostConcierge.ai provides software-enabled, automated tools intended to assist short-term rental hosts and property managers with guest communication and informational support. The Service generates automated responses based on information provided by users and automated systems.
The Service is provided on an “as-is” and “as-available” basis. We may modify, suspend, or discontinue any part of the Service at any time, with or without notice.
HostConcierge.ai does not act as a property manager, host, agent, representative, or decision-maker on behalf of any user. The Service does not monitor properties, verify conditions, or independently confirm the accuracy, completeness, or timeliness of information provided by users or third parties.
2. User Responsibilities
You are solely responsible for:
The accuracy and completeness of all property details, house rules, instructions, and content you provide
Monitoring guest interactions and responses generated by the Service
Ensuring compliance with all applicable laws, regulations, HOA rules, and platform policies (including but not limited to Airbnb and Vrbo)
You agree not to use the Service for any unlawful, misleading, deceptive, or harmful purpose.
3. No Professional, Legal, or Emergency Advice
The Service does not provide legal, safety, medical, emergency, or professional advice. Automated responses are informational only and may be incomplete, outdated, or inaccurate.
The Service is not intended for use in emergencies. In the event of an emergency or urgent situation, users and guests must contact local emergency services or appropriate authorities directly.
Hosts remain solely responsible for all decisions, actions, communications, and outcomes related to their properties and guests.
4. Subscriptions and Billing
Subscription plans renew automatically unless canceled prior to the applicable renewal date. Free trials, if offered, convert to paid subscriptions unless canceled before the trial period ends.
Fees are non-refundable except as required by applicable law.
5. Intellectual Property
All software, system design, content, prompts, workflows, and outputs generated by or through HostConcierge.ai are owned by HostConcierge.ai or its licensors.
You are granted a limited, non-exclusive, non-transferable, revocable license to use the Service solely for its intended purpose while your subscription remains active. No ownership rights are transferred to you.
6. Third-Party Services
The Service relies on third-party platforms and providers, including but not limited to AI services, hosting providers, payment processors, and short-term rental platforms.
HostConcierge.ai is not responsible for outages, errors, changes, interruptions, or disruptions caused by third-party services.
7. Termination
We may suspend or terminate your access to the Service at our sole discretion, including for misuse or violation of these Terms. Upon termination, your right to use the Service immediately ceases.
8. Limitation of Liability
To the fullest extent permitted by law, HostConcierge.ai shall not be liable for any indirect, incidental, consequential, special, or punitive damages, including but not limited to errors in automated responses, guest conduct, property damage, lost revenue, or service interruptions.
HostConcierge.ai’s total liability for any claim arising out of or relating to the Service shall not exceed the total fees paid by you to HostConcierge.ai in the twelve (12) months preceding the claim.
9. Indemnification
You agree to indemnify, defend, and hold harmless HostConcierge.ai and its owners, officers, affiliates, and agents from and against any claims, damages, losses, liabilities, and expenses (including reasonable attorneys’ fees) arising out of or related to:
Your use of the Service
Inaccurate, incomplete, or misleading information you provide
Guest interactions, disputes, or incidents
Violations of applicable laws, regulations, or platform rules
10. Arbitration and Class Action Waiver
Any dispute, claim, or controversy arising out of or relating to these Terms or the Service shall be resolved by binding arbitration on an individual basis.
You waive any right to participate in a class action, collective action, or representative proceeding.
The arbitration shall take place in Charleston County, South Carolina, unless otherwise agreed by the parties.
11. Governing Law
These Terms are governed by and construed in accordance with the laws of the State of South Carolina, without regard to conflict-of-law principles.
12. Modifications
We may update these Terms at any time. Continued use of the Service after changes become effective constitutes acceptance of the updated Terms.
